PARTICIPANT WAIVER AND RELEASE ACCEPTANCE OF RISK / WAIVER AND RELEASE OF LIABILITY / APPEARANCE AGREEMENT

I, hereby acknowledge, accept and represent that participation in the activities for which the participant is registered to attend includes strenuous physical activity and involves foreseeable risks of serious injury (including paralysis and even death) with or without the negligence of others. Participant, on his or her behalf, and the parent/guardians, on behalf of Minor Participant as well as on their own behalf, unequivocally agree to incur and assume such risks as a condition to participation in the activities for which Participant is registered. I hereby release the directors and employees of Borona Arts Entertainment, LLC, from any and all claims for damages, thefts or injuries which I or my children or students may sustain while participating in any activity connected with this event. In addition, if anyone (whether a Participant, Minor Participant’s parent/guardian or anyone else on behalf of a Participant or parent/ guardian) makes a claim against any of the Releasees despite this release, then the undersigned agree to indemnify and hold harmless, each of the Releasees from any litigation expenses, attorney fees, loss, liability, damages or cost any release may incur as the result of such a claim. Furthermore, the undersigned represent that the Participant is healthy and has no physical or mental condition that would impair Participant’s ability to fully and safely participate in the contemplated activity. Furthermore, the undersigned represent that the Participant is healthy and has no physical or mental condition that would impair Participant’s ability to fully and safely participate in the contemplated activity I, the participant, parent and/or guardian, do hereby consent and agree that Borona Arts Entertainment, LLC its employees, or agents have the right to take photographs, videotape, or digital recordings of me to use these in any and all media, now or hereafter known, and exclusively for the purpose of marketing, publicity. I further consent that my name and the name of the participant and identity may be revealed therein or by descriptive text or commentary. I do hereby release to Borona Arts Entertainment, LLC, its agents, and employees all rights to exhibit this work in print and electronic form publicly or privately and to market and sell copies. I waive any rights, claims, or interest I may have to control the use of my identity or likeness in whatever media used. I understand that there will be no financial or other remuneration for recording me, either for initial or subsequent transmission or playback. I also understand that Borona Arts Entertainment, LLC is not responsible for any expense or liability incurred as a result of my participation in this recording, including medical expenses due to any sickness or injury incurred as a result. I represent that I am at least 18 years of age, have read and understand the foregoing statement, and am competent to execute this agreement. I, in my own behalf and on behalf of the Participant, hereby warrant that I have read this form in its entirety and fully understand its contents and are voluntarily in the agreement of the same. I, on my own behalf and on behalf of the Participant, am aware that this Release and Waiver releases from liability and contains an acknowledgment of my voluntary and knowing assumption of the risk of injury or illness. I, in my own behalf and on behalf of the Participant, further acknowledge that nothing in this document constitutes a guarantee that the Event will occur.

​Refunds. All registrations are non-refundable, No exceptions.

Credits. On a case-by-case basis, registered participants who are canceling due to illness or injury may do so if authenticated with an official doctor’s note. Participant will be credited the cost of their registration to be used towards a future ADE event. Credits are valid for one calendar year and will not be issued for any other reason.

Scholarships.

Wristband Policy. Registrants receive only one band for the convention. Wristbands may not be removed for the duration of the convention. Removed bands may be brought to the hospitality desk for a replacement upon verification of your current registration. Lost bands will be charged the convention rate. Pre-registration is strongly suggested as some bands may sell out. Wristbands may not be transferred from one person to another. ADE is not responsible for lost or stolen bands.

Transferring Cities. Registrants are allowed to transfer tuition from an ADE regional city to another ADE regional city in the same tour without an administrative fee for up to 1 switched city, additional transfer cities requests will have a $30 administrative fee. Registrants are also responsible for any differences in tuition resulting from the transfer.

Inclement Weather Policy / Force Majeure / Rescheduled and/or Cancelled Events. In accordance with the ADE Refund Policy, All Registrations are non-refundable. ADE will not provide any refunds to participants if inclement weather in origin or destination city hinders their travel plans. ADE will gladly credit registration for a future ADE event on a case-by-case basis in accordance with the ADE Credit policy. In the event of any other Act of God during event dates including but not limited to: (Major Weather Event that results in a state of emergency in event city, the war within the continental USA, governmental authority, disaster, strikes, or any other emergency) making it illegal, impossible or inadvisable to hold the event, ADE Executives in accordance with the city, state and local law enforcement will cancel or postpone the event to another date in the future. ADE will offer only credits to all registrations for a future regional ADE event and no refunds are given. In the event that ADE needs to cancel, reschedule or postpone an ADE event, all pre-paid registrations will be moved to the new rescheduled date or a credit will be given for a future ADE event upon request, no refunds will be issued.

Observer Wristband Policy. Pre-registration is strongly suggested as observer bands may sell out. If still available, they will be sold at the door starting on Friday at early check-in and/or throughout the weekend. All observer bands are non-refundable and may not be transferred from one person to another ADE is not responsible for lost or stolen bands. You must be accompanying a dancer to observe. Noise level and activity should be kept to a minimum out of consideration for the faculty and dancers. No cell phones, talking, videotaping or note-taking. ADE reserves the right to remove anyone who is disrupting the workshop or not following Security directions.

Medical Release. I acknowledge and agree that participation or observation in the Event subjects me to the risk of physical illness or injury (minimal, serious, catastrophic and / or death) and that I acknowledge that I am assuming the risk of such illness or injury by participating or observing in the Event. In the event of such illness or injury, I authorize ADE to obtain necessary emergency action medical treatment for me and hereby release and hold harmless Releasees in the exercise of this authority. I further acknowledge and understand that I will be responsible for any and all medical and related bills and expenses that may be incurred by me for any illness or injury that I may sustain during participation or observation in the Event and while traveling to and from the site for the Event whether or not the event actually occurs.

Disclaimer. ADE staff reserves the right to remove any person (or persons) who presents potential harm, danger or disruption to themselves or anyone else while attending the Event. Faculty line-ups in each city are subject to change.
